My new target is 200. It was 100 before the deadline was extended.
58 collected so far (excluding the 24 letters at Fremont train station)
Besides, I prepare & mail about 20 envelopes a day to WH=> these envelopes contain letters coming in from several folks in CA.
This weekend, NORCAL will do not 1 but 3 drives:
Sunnyvale temple
Grocery stores @ Sunnyvale
Grocery stores @ Fremont
For more details, check out the latest messages on NORCAL yahoogroup!
Proud to be part of CA letter campaign with you folks! 200 here we come....will dig about in SF :)

My current H1B was sponosred through an educational institution and was hence cap exempt. Will I be able to transfer my current H1B if I decide to move to a private company?
Thanks!
Thanks!

It appears that way on the surface, but I think this is subject to country quota also. So until ROW EB3 clears(since EB2 ROW was current) possibly no spill overs. But the biggest problem with this 90K for 5 years is based on some math they did with pending LCs and 140s etc. However did they anticipate dependents numbers correctly which is unknown till 485 stage? What happens if the backlog is 450K + 100K(just an assumption) when dependent numbers are added? You wait 5 years and realize you were not cleared through this system because you were part of that additional 100K . Now you fight your battles in the point system with a country limit of 14K(10% of 140K). So there are about 70K(14K*5) numbers being used up in MBS during those 5 years for a given country, not sure if that is the saving grace for any kinks in the backlog reduction numbers, but you have to figure new people are coming in every year and will compete for these 14K Visa numbers. It will be 38K when Z visa holders become eligible, but that is still a lottery proposition at best. So this could be really bad for few unlucky ones. Even though we have 485 applications in the system, if the numbers do not work out a few people are gonna loose big time.
Best case scenario is that we all get through under the backlog reduction, but future generation from India/China will have to play lottery for GC's.
This year with overflows from ROW category, maybe 40K extra numbers were used for backlog reduction. Adding 10k for each china and India it makes the number 60K. Isnt 90K better than 60k (if we are lucky) under current system?

I dealt with Fragomen for last 7 years. I can say following about my experience
I work for fortune 500 company and Fragomen was the law firm my company used until early 2007.
1> The emails, voice mails I sent to them used to disappear in a black hole. I had to wonder whether and when any response will come to an urgent, time sensitive question.
2> Many times after waiting a week or so for response I had to escalate the matter to my companys legal department to talk to Fragomen. This used to work like charm, I used to get answers within hours.
3> I had to keep them reminding them about next step to take, as delay from their part had cost me years in the processing.
4> I think many of my co workers had similar experience and that is why my company finally switched to different law firm in Jan 07.
5> I hoped to never to deal with them again but last week I got invoice from Fragomen for something the did for my case in Jan 2006! I dont know why they sent it so late and why directly to me instead of my company. Well, this time I am going to wait until they call me to take any action on that invoice.
So they lost a Fortune 500 client because of their customer service and I think they will continue to loose more if they dont change.I hope somebody from Fragomen reads this and fixes their system. To me I am very glad that my company left Fragomen !

Overall - $5000.
Advance - $2500 within 30 days to start the work.
Is the overall work something like 100K that they have divided by the number of requests to yield 5K per request? Unlikely. I think they just sent standard 5K demand to each FOIA request to shut it down.
Even if they pay me $2500 for pulling out this info. Just 5 mins job to run the query and imagine if they get 10 requests per day. Man I wud be a millionaire within no time.
Atleast they acknowledged that it requires highly skilled individual(from their perspective) to do the job.

Main reasons for restrictions in legal immigration are
1. Organised compaign by anti immigrants with data. They proved that H1b persons were paid 20% below the market rate. There is no defence from orgainised compaign by pro immigrants. Pro immigrants gave the statement that shortage of skilled workers but they were not able to give supporting data. Newspaper stories are not enough
2. Reaching h1b cap in 2 days gave negative picture instead of positive. Mostly consulting companies rushed to get h1b without valid job positions
3. Instead of asking reasonable numbers Corporations and pro immigrants asked exemptions in H1b numbers and green card numbers. They want to make sure that unlimited numbers so that they can hire or fire anyone.
4. Immigrants are suffering by backlogs and they are expressed by IV and Lawyers. But that is not enough to justify immigration. That should be justified with real need for welfare of country
5. Before dot com bust even lot of US citizens welcomed H1b persons as there was not much layoffs. But past 7 years layoffs increased to outsource to India,China and other countries. For that they have to hire H1b and L1 persons from Countries mainly India. Those things made anti immigrants hardened their stand. US workers fear that they may lose job if US opens up immigration too much.
6. Some Indian consulting companies exploited the situation by just hiring H1bs not even trying to recruit US workers even if they available. But some Indian companies like TCS,Infosys started hiring US workers nowadays because of shortage of H1b.
H1b persons are considered as best skilled persons so Companies can afford to pay 5000 or even 10000$. Infact H1b persons should be paid 20% above US workers as they are considered as better than US workers. That is the reason for raising the fees by two thirds of Senators
Microsoft was doing effective compaign. Infact they asked resumes from programmers Guild. If many people do realistic campaign instead of opposing anti immigrants that will be easy to reform immigration
I am sure that the tech lobbyist are going to change the rules applied to the H1-B process, because everyone knows the effect of this to the econoomy. I am totally convinced that the strict H1-B rules will be removed.
I am trying to figure out or want to see how or will these tech companies force or lobby to get EB relief.
How important is EB relief for them?
1) they can't hire brains from US universities.
2) they can't hire those who they think would benefit the company but are stuck with their GC process with some other small consulting firm.
I see STEM with advance degree getting relief, the current backlog will not be benefitted a lot (eg. Real hike in EB visas, Removing the country cap). I am not being a pessimist but, I do not see a light in my path. (May be my comments are wrong)
**** Important Note****
After the State Union Speech given by the President to change the Immigration system, we saw a huge applause by all the law makers. So many individual bills in favor of Skill were introduced. Mr Gates, in front of Senate gave a detailed explaination of our problems, we saw few bills after H1-B quota ran out on the second day of the filing date added to the senate judiciary committee.
Our hopes increased after seeing so many favourable documents and media coverage, but what happened in the end.. Illegals were given a very very very easy path to citizenship after breaking the law. They get a relief which we can never imagine will ever happen to us.
Let us say we get the oppurtunity to file I-485 without PD. Increase in H1-B, Increase in EB visas. But still we have to stick to an employer, can't move up the ladder because of the same Labor description needed to be mainain I-485 if we take AC21.
I cannot digest and will never be able to digest that we are not given the oppurtunity to file our I-485 individually and work for any employer.

I also came with Fragomen filing my H1B case with one of below mentioned US company in ERP, and they started my GC only after 2.5 years of service with them. 2 Years was the norm, but another 6 months will pass to get the experience letters from previous companies with the exact format and tools they want etc...Finally filed in 2008 jan, but after the filing, it has been smooth for the labour, 140 so far...
HP, Cisco, TCS, Deloitte, IBM, SAP, ORCL....I am going to add one more so called big firm BEARINGPOINT (formerly known as KPMG consulting).
I know that Fragomen specifically guides and runs the visa/GC related matters of Bearingpoint. They charge 10,000 dollars for a GC case and give clear cut instrucation to Bearingpoint that do not file GC till the very last moment. I left Bearingpoint (16000+ employees and offices in 43 countries...sounds great doesn't it?) because of my immigration issues caused by Fragomen. I joined a desi consulting company with 2 employess. This desi company manager took my GC file in his hand, drove to attorney office and asked him to file it ASAP. No waiting period, no nothing....
Big corporation + Fragomen is a deadly/toxic combination. Stay away from it if you can.

my I-485 was nicely pending @ TSC, and the company just sent H1 papers off to VSC for processing, so I can come back on H1. I am currently sitting in London (working for my GC employer from their UK office), when I got the Card Production E-mail. My previous H1 approval expired in March.
My EAD will expire next month, as well as AP. So, here is the rub, they will not let me come back to US on AP since system shows GC approved, H1 will be rejected since GC is approved.
needless to say PD is not current. I kind of remember having an approved RIR Labor with PD June 2004, but I dont remember having sent for I-140...No idea what to do and how to check that.
Dont trust company's lawyer, and I sent all I-485 papers by myself back in July 2007. I have an attorney that I bug from time to time but he is on vacation now...
So... am I completely screwed...?
My employer transfered me from US to UK couple of months ago, now they are transfering me back. I did go for H1 stamping in Dec here in London and IO said something like, my GC is taking too long, he will check why I dont already have it..
Just venting here, no clue whom to talk to next....
Any suggestions are welcome...

I BEG to differ. I called USCIS today morning and the rep told me VERY CLEARLY that ANY application received on July 2 will be ACCEPTED as July 2 is the cutoff.
A few min later my spouse called and they told her, Everything would be rejected.
USCIS customer service center, currently cant differentiate their A** from a hole in the ground!!
hilarious!!!!

Thanks for replying MC. One more question. Can I send one combined check for my spouse and me?
you must send individual checks. Filing online is the best thing.

I for one think that the SKIL provisions will be in the manager's package like last year.
I thought the SKIL provisions were already present in last years bill when it was offered - were the SKIL provisions added in the manger's package last year??

Yes, every outraged indian should send an email to Air France. The content of that should clearly indicate that they will never fly Air France again due to these "racial" discrimination allegations.
That should teach them a lesson.
