I have been without a pay for 2 months now, will that affect my I-485 application which was filed in July 07
Get a job ASAP - when ur 485 is being adjudicated - they will ask for job proof and it would be good to have as many paystubs.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. Hi,
I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?
I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

I think answer is NO if you want to come back of L1A from B employer.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).
With H1B, you will be on USA's payroll for that period.

I did my Masters and then got a job in Company A who filed my H1b Visa on 10/01/2008 and valid until 07/25/2011.
I did not get stamped yet as i never leave US until now.
Meanwhile my employer applied for amendment as i was put into a project in another state and change in my title .
When i check the status it says "On May 7, 2010, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
I am going to my country on August 2nd week for my marriage and my questions are.
can i use my current I797 for visa stamping or should i use new I129 which i did not get yet?
can i use the notice as the proof of I129 in case they need it for stamping?
Also could somebody please tell me how long will it take to receive my I129 after the above mentioned status?

My 11 year old neice is in Hong Kong and I want to know
could she come in as a tourist and have a school accept her in Houston Texas, then change the status into student using I-20 issued by the school?
how long it will take to have the status change? more than 2 months?
Do I have to get an immigration lawyer to do it? Or could I do it myself? If yes what is the form number?

I am on the 8th year of my H1B. I have an approved I140. There is a chance that I may have to leave my current job, and there will be a gap before I obtain another job. Two questions:
1. Can I stay in the US just on an approved I140 and no H1B?
2. I know I can get my H1b transferred. Can I instead leave my current job, be on I140 for some time, and apply for a new H1B for the new job, still continuing the 8th year?

I entered U.S with B1/B2 visa and got changed into F1 status. While F1 status got approved
I departed U.S due to family matter.
Now I'd like to make it sure that my B1/B2 visa is still valid,because I plan to visit to my friend who lives in U.S.
How to check my B1/B2 visa could be remained still valid?
Or does somebody know anybody who had been in same situation?

You can only stay in the US if you can change to another lawful status. As a UK citizen, the only work-authorized status that might be available, though difficult, is O-1 for extraordinary ability aliens. Please see my website link for a description of different categories: nonimmigrant visas (http://www.martinvisalaw.com/nonimmigrant%20visas.html). If the company won't start the permanent residence process for you, unfortunately you have very limited options.
