You people seem to be too nationalistic. Even with the comments about quotas. Affiirmative action with 52% of all seats being reserved based on caste? You call this fair?

Raydon, thanks for expressing your situation. But I still feel we are not requesting TSC to expedite our cases. All we are asking his, please do justice to us and follow the FIFO for the I-140 petitions. TSC has been consistently approving cases filed in recently and just continuing to ignore our cases. If you can explain your attorney, I am sure he will understand. Or atleast have him, fill out form 7001 on your behalf and send his own letter explaining the situation to Ombudsman's office.
I understand that I-140 is employer petition, but it ulitmately belongs to you. So you need to do whatever you can do some how convince your employer or attorney to assist you one time. I-485 is your petition, and you do not need any consent, if you need to send a letter to Ombudsman's office. So please try your best and see if you can mail the form & letter to Ombudsman's office.

My employer is a big and prestigious (supposedly) company and will not want to sign this petition or do anything against the counsel of the attorney. The attorney is not gaining anything by expedited processing of the I-140 and won't support this either. He's an AILA member too, if that's of any significance.
If this is worthless without the employer's signature, then I'm unable to participate in this campaign, though it is a worthy effort.I would urge all members who can get the employer's consent to definitely participate and wake up the USCIS from it's slumber.They need a big kick up their you-know-where, especially the TSC.

If u applied 485 in June 07 u might have already been alloted a visa number...Call uscis to find out...A nicer IO may give u some details abt your case

I think you are unnecessarily suspecting her posting. Retrogression kicked in Oct 2005 bulletin. So it is possible for her to apply in Feb 2005. I know for sure some people got their GC with similar priority dates. I think this whole immigration crap is turning everyone into cynical.
I think you are talking about EB2 India. EB3 india were retrogressed from Jan 2005. Correct me if I am wrong.

Flower campaign had similar fate - 2 to 3 truck loads of flowers just went into hospital. it was more of Lofgren involvement that helped us.
We need to think with cool heads and execute things properly - first organize ourselves - gain support - consult our counsel - come out with proper plan of execution.
From what I observed the action of USCIS redirecting flowers to hospital and armymen backfired. It was perceived as an insult to the brave soldiers.

Enforce EXECUTIVE BRANCH AGENCY - USCIS to consume unused EB Numbers
Firstly, the executive branch agency USCIS failed to UPHOLD the law by not fully issuing 140,000 numbers when there was hugh backlog.
Secondly, Change the following:
1. Allow USCIS to use previous unused EB numbers since 2000.
2. Change the way the Dept. of State allocates the EB numbers throughout the Fiscal Year. The Dept. of State should allocate the EB numbers UNIFORMLY across the 4 QUARTERS.

Funds are really needed but another important thing is to leverage the momentum obtained due to CIR and more recently July Visa fiasco.
I think iV should aggressively focus on recapture of visas, 1 visa per family(Hillary Clinton already supports us on this and we can rope in Zoe loe****
who supported us now) and also removing country based limit.

No labor (NIW). PD April 2007. 485 in July 2007. All @ NSC
My wife got RFE. Answered and received by USCIS on 26th Nov 2008. States "RFE received, case processing resumed". Soft on 2/25/2009.
My 485: Case received on 24th July 2007... blah..blah...blah. Soft LUD 11/10/2008.
EADs are approved and later renewed in 9-10 days (yes, 9-10 DAYS, USCIS is lightning fast in this aspect) at TSC, 2 yr EAD.
NSC says my preadjudication complete, FBI cleared and waiting to be assigned to an officer. Same case as others "pending...VISA availability".
Unless there is a legislation change, I have to wait till PD becomes current. However, the adjudication office can override the PD and allocate VISA number with a justification. This has happened to many people, so PD and VISA allocation is not an absolute must.

These Govt. agencies are so efficient that they can even go through these forums and connect IDs here to applications. It is a piece of cake for them to find out the entire background of an applicant as soon as even the LC is filed. They very well know who is stuck with which employer in which state and what stage and to whom they are approving the GCs. If the employers are Americans, they can even call the DOL and ask them to hold the LC approval because they know that once their employees get their GCs they will quit them.
I am not trying to be negative and pessimistic, but please think about the chances of immigrants sueing these Govt. agencies during any of the stages in GC process and winning the lawsuit. And ofcourse, the immigration lawyers are too happy with the retrogressions and the way the immigration system works in this country.

My husband has been working on H1B with a leading company in USA since early 2000. Our Labor was filed in March 2005 and is stuck at BEC. I am on H4 and am not able to work or contribute.
One of our friends starting working in USA through a consultant in late 2004. Filed his I-140 directly with a substitute PD in June 2005. They received their EAD same year in October 2005 and received his physical Green card on February 2006 . He used a priority date of 1999 due to his substitute PD. Now he is a free bird and can move jobs, his wife can work and they receive all the benefits of green card.
How fair can this be?
We are unable to move, take up a better job, receive a promotion or take up fulltime studies even after getting admission in best Universities due to our Visa situation.
Sweeping changes are necessary in immigration rules and the date the person starts to work on H1B should be considered as the priority date. It will eliminate lot of corruption and reward those who truly contribute to the economy.

Pardon my ignorance.... Can you enlighten me as how Vertical and Horizontal spillover works ? What exactly happens in Vertical spillover and how is it different from horizontal.
horizonal is unused visa's from a category flow down to other categories this way:
EB2 ROW -> EB2India + EB2China -> EB3 ROW -> EB3 I+C, or
EB2 ROW -> EB2India + EB2China -> EB3 (ROW+I+C)
there is some controversity about the last one, some people believe it flows through EB3 ROW and comes down, others say EB3 is all treated equal. Based on data in the past (the fact that EB3 India got tens of thousnads of approvals in 05 and 06 even though EB3-ROW was retrogressed, means its mostly the latter (EB3 (ROW+I+C))
