I am currently on H1B visa which will expire next year ie Nov2011. My employer just stated that due to economic conditions, they will not be able to file my GC.
My husbands company has already started his GC process ( his labor n I140 is done)but my name isnt on his application yet. We are waiting for the date to become current n then my name can be added on is 485 application as his dependent. His PD is Aug 08.
Basically I was interested in knowing abt future based employment GC. Has anyone done that before?
Is anyone aware of companies who would be interested in doing it. I just need to buy like max 2-3 years ....just to keep my H1B extensions going. I like my current job so really want to avoid changing it unless there r no other options left basically.
Pls suggest me options that I have to get H1B extension after Nov 2011 and continue working.
Any suggestions are appreciated. Thanks!

IV Members,
I am not able to figure out if this new Merit Based System (if implemented is good or bad for us)
If the guys who already have made some progress using the existing system are asked to re-apply under this new merit based system, it is going to be bad for them, because they have to go through the entire process again.
What about people like me, who are new commers to US ?
If I apply under the new merit based systems, am I automatically subjected to backlog, because people who applied for GC under the previous system have not yet gotten their GCs, or this new merit based system will have its own quote ?
Can anyone explain ?

I have done so and did not find any additional issues as compared to H1 upto I140 approval.

My OPT ends dec 08 and my H1 got selected in lottery but received RFE in Oct and case is still pending. Can I go for OPT extension right now as there is just 1 month time to file it?? Or should I go for premium processing of H1 and then go for OPT extension filing depending on H1 case result??
If I go for OPT extension right now even when H1 case is pending,
1)What happens to that OPT extension case if H1 gets approved?
2)What happens to that OPT extension case if H1 gets rejected?
Help me..

My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!

Which comes first.....card production ordered or approval sent? Are there cases when they don't update the status online with "approval sent" yet you have physically received the EAD cards. How long does it take to physically receive the cards from the date the status changed to card production ordered?

My company is filing 140 and 485 on a preapproved LC (PD of 2005)
But my original LC in P-BEC just got cleared (PD of 2003). They told that they will also use my original LC for 140 as this gives better chance than the substituted one.
1)How Can I have 2 140's ?
3)How will it effect 485?

I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

I have two I - 140s pending (say A and B)
I am applying I-485 for A (140)
If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?
Or do I need to apply for I-485 freshly with I-140 from B?
