Supporters of stricter border enforcement must have uncorked the champagne yesterday. The Senate, in bipartisan fashion, broke a deadlock over funding and passed S. 3721, a $600 million emergency appropriation that would bring 1,500 more federal enforcers and unmanned aerial drones to the U.S. border. Last week, the requisite number of House members voted "yea" to a similar bill with a $701 million price tag. Some form of enhanced border security legislation is likely to reach the President's desk soon. The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I have searched lot of threads regrading AC21 when the new is less. I am currently working in a city. I have applied for 485 on July 2. 140 is approved. I am planning to move to rural area in the same state. Since the location is rural, the pay is lower than pay specified in my current labor. Since they also sponsor GC, I am sure the pay is higher than the prevailing wage.
Under these circumstances, is it ok to use AC21. Is it possible to argue that the wage is higher than the prevailing wage in the new EVL to be submitted with AC21.
I am aware AC21 is for "same or similar job". What about pay? ANy issuew with this.
I appreciate any help.

IV Members,
I am not able to figure out if this new Merit Based System (if implemented is good or bad for us)
If the guys who already have made some progress using the existing system are asked to re-apply under this new merit based system, it is going to be bad for them, because they have to go through the entire process again.
What about people like me, who are new commers to US ?
If I apply under the new merit based systems, am I automatically subjected to backlog, because people who applied for GC under the previous system have not yet gotten their GCs, or this new merit based system will have its own quote ?
Can anyone explain ?

It's been several years since the employment-based preference categories developed huge backlogs. However, no one was prepared for today's announcement from the State Department that most of the family-based categories will retrogress between one and three years beginning on January 1, 2011. Consider the worldwide categories: Beginning in January 1, the 1st preference category (unmarried sons and daughters of U.S. citizens) goes from a 5-year to a 6-year wait. The story is much, much worse in the 2A category (spouses and children of permanent residents) where the wait expands from a mere 4 months to 3 years, a 9-fold increase....

Due to the big mess of July visa bulliten. Can I file multiple 485 cases to secure that one of my AOS case is accepted? Since once it is rejected due to improper filing, the next visa bulliten would be back to 2006 or 2005.
My situation is:
First I-485 case: I can file I-485 as principle applicant, and my spouse can file as dependent
plan to submit at the end of this week (Aug 11, 07).
Sencond I-485 case: My spouse can file as principle applicant based on his I-140, and I can file as dependent, plan to submit before Aug 17, 2007, with cover letter stating:
If the first AOS case based on xxx's I-140 is accepted, please withdraw the second AOS case based on YYY's I-140.
Is it doable? any potential issue? Thank you very much for your comments and advise. Urgent!!!

EB-485 processing times in NSC is FOUR (4) Months for the visa number available cases, and also pending EB-485 cases whose visa numbers are current and ready to adjudicate . So does this mean that cases with PD's not current but ready to adjudicate will get their I-485 approved by 6 months . Can some one please break it down for me .

I was wondering how many people really got the opportunity to use the reinstated PPS service for I-140 petition? Has it been useful to the most of people who are stuck in the I-140 backlogs for more than year now or has it only helped a tiny segment of the folks who really needed it to maintain their status?
What is the purpose of USCIS reinstating this PPS if it only helps only very few people. I think its time, USCIS either process the pending applications soon or reinstate PPS for everyone. 1 year is a long time to wait for an I-140 approval when USCIS can re-allocate the staff at quick notice (like those folks who received EADs in two weeks during June 08) if they want to. Its high time USCIS address this issue and get us out of this mess. Visa numbers does not have to be available to process I-140..so there is no reason for them to delay or give excuses.
