Following is my case details -
Visa and I94 expiration date: 12 Sep 2009
Filed H1 extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009
Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009
What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?
Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

On November 27, 2009, the USCIS announced that 58,900 of 65,000 regular cap petitions have been received. In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here...
On November 27, 2009, the USCIS announced that 58,900 of 65,000 regular cap petitions have been received. In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here on out will count toward the regular cap of 65,000. The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.

Hello,
I am not sure if this is good place to ask this.
1. I have moved out of US 5 months ago and I am working for my GC sponsoring employer overseas. What happens to my I-485? Is it considered abandoned?
2. While I was working as H1 I contributed to 401K. I want to know if I can leave that money in the US till retirement age and then start widrawing while living overseas. I expect I will not be a US citizen at that point.
Can anyone point me to a competent accountant who can help with question 2?
