    IF I COMPLETE MY M.S. IN 1 YEAR AT A U.S. UNIVERSITY
    AND THEN IF FILE A H-1B THROUGH A CONSULTANCY

    WILL COMPLETION OF MY M.S. IN 1 YEAR BECOME A PROBLEM FOR GETTING A H-1B IN THE MASTERS (M.S.) QUOTA OF 20,000?

    BCOZ SOME OF MY FRIENDS TOLD ME THAT IT IS NOT GUD TO COMPLETE M.S. WITHIN 1 YEAR OR IN EXACTLY 1 YEAR, LATER IT BECOMES A PROBLEM FOR GETTING A H-1B THROUGH M.S. QUOTA.( THEY SAID THEN I WILL HAVE TO GO THROUGH GENERAL 65,000 QUOTA AND WILL NOT BE ELIGIBLE FOR 20,000 M.S. QUOTA, if m.s. is completed in 1 year)

    IS IT TRUE, IS THERE ANY SUCH IMIGRATION RULE DURING H-1B FILING

    My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.

    The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

    Appreciate your inputs:confused:

    I was scheduled for Infopass today and found out the alien number assigned to my I-485 application is not the one mentioned in I-140 and belongs to somebody else in florida. I called NSC and they processed the service request and told me to wait for 45 days. I talked to NSC directly and without checking my application details, the officer tried to assure me that it is something that they will be able to fix when they will adjudicate my case. My EAD and fingerprinting were cleared under the wrong alien number and my lawyer told me that the alien number is assigned by USCIS. I will check my documents to find out if they did that mistake.

    Anyone else got in similar situation or know about someone with the same issue?

    I have an issue with my recent H1B approval on Feb'2010. I am seeking your advice in this regard.

    I have been in H1B since 11/01/2005 , entered US on 04/20/2006 and my PERM has been already approved with a PD of 03/15/2009. My current I 94 is expiring on 4/13/2010. Recently I got an H1B extension approval of just 1 year (4/13/2010 to 4/13/2011) , which is less than actual 6 years with approved PERM.

    Do you think that any appeal or ammendent can be done to extend the approval period? With my H1B petition I had to enclose a client engagement letter which confirmed my engagement but didn�t have any engagement end date there.

    If you think that any appeal or ammendent can be done with USCIS, then kindly advise me accordingly. Thanks

    Dear All,

    I just have one thing to say to you all. You did bring attention and top newspapers covered our plight. I am seeing newspaper articles from NYT, Business week, BBC and Washington post.

    Remember everybody, It takes mighty work to shake this, and we did that mighty work and I think you shouldn't be overcritical and wait for the fruits of labor to bloom.

    We will do it one day........ we shall overcome one day... :-)

    Just keep this passion going, if steam fizzles out, everything will flatten out and we will have to be on this all over again, so never let that happen.

    My I485 is pending. My co-workers' who applied the same time as me already got their green cards. I am planning to go back to my home country in Feb. What if my green card is approved while I am outside of US? In this case, can I still use my AP to come back?

    Hi,

    I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.

    Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.

    My questions is -- How do you count the expereince if its Masters + One year
    Will you count one year after finishing the Master Degree completed (or)
    Will you count one year after finishing the Bachelors Degree.

    I applied for H1 on Oct 10 2010. I got an RFE - (relatively benign - proof of labor cert filing) on Feb 22. My attorney responded and they changed the status to RFE Response Review on March 3rd. Unfortunately, I'm planning to go to India on the 26th.
    - Would upgrading to Premium help at this time?
    - What is the typical response time between RFE response review and decision?
    btw, this application was processed in the Vermont Service Center.
    Any help would be greatly appreciated. Thanks in advance.
