Problems will not go away. Such incidents may happen elsewhere or in the same place.
If Air France was genuine they should have made everyone stay in the same place or atleast talk to theie department of immigration and arrange a temporary supervised visa and take all people to the hotel.

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.
Another perspective is that if people with Masters or higher degree are exempted from the EB quota, it will in fact help in moving the priority dates current, since there are lot of people in wait who already have advanced degree from US universities and won't be using up the visa from the EB quota.

Dems winning the house is definitely a good news. Senate was always favorable to us. It was "majority of the majority" in the house that was totally against any kind of relief barring something for nurses. Most of the IV members know the retrogression story SR1932 onwards. But six months before that senate had approved relief for all EB categories under Tsunami Relief Act And the republican lobby in the house restricted it to nurses only. That was HR1268 of April 2005. You can refer to Murthy chat session of May 9, 2005 to read some info on this.
The presidential elections were just over then and primaries were not on the horizon for this congressional election. In short house republicans would have blocked any immigration relief; elections or not.
With Sensenbrenner and Hastret gone, at least now we have new people to deal with and we know they are more towards the center. We can now hope that our prayers would be answered.

Well majority of the people on this thread and forum is finding this as just cause, I am totally for it.
However no one is sure if this logic will hold water. Well none of us are lawyers, thus our arguments for or against doesn't hold. Someone said at the start of this thread that let's consult some big lawyers.
People are ready to contribute (including me) and I personally think that IV Core will be the best forum to take this up with lawyers. They already have an existing network, have folks that have participated in efforts related to legal immigration,

Also since so many people (once again including me) are ready to contribute, IV can become forum to raise money for this Legal challenge...like another pool.

H1B visa is meant to be for people with skills that are in shortage in the US. If any H4 feels that he/she should be able to work, he/she should get a H1B. I agree that it may be difficult for some H4s to find a sponsorer for H1B, because their skills are not in shortage in the US.
Some spouses may join their H1B counterparts in the US, with an expectation that they will eventually get the GC and will be able to work, no matter what their skill set is. This is a reasonable expectation. So, blame the retrogression.
I do not believe that H4s should ever be allowed to work. They just take away jobs of more skilled workers who are unable to get H1Bs and who are still in their home countries trying for one. Skill-less free riders!
Now, please don't bash me with counter arguments!! ;)
sorry but this is ridiculous. If the US has a skill shortage and wants foreign workers, it should ensure that the foreign worker and his/her family are given the same rights that a domestic workers family enjoys.
If they can't give that right, why do they want to invite the foreign worker at all?
Its true that they are not forcing this on us and we are free to go back anytime. But still isn't the inequality pretty clear here? and this country is supposed to be all about equality...

I know i keep bumping this thread but I am surprised that no one has posted any experiences regarding the AP. I mean i see a TON of stuff about EAD renewals but nothing specifically about the AP. I guess ppl are more interested in making money than leaving the country (like ME ;) )

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.

Got the letter last week and I am willing to contribute for this cause.
But if we are paying up I think we should find out who has the earliest notice date / number and use that to ask for the info that way we can avoid at least some of the backlog.
Even though I have voted for $25 contribution, wouldn't mind paying more if there is a shortage of funds.

Looks like the Congressman's (Rep. Lamar Smith) office is getting bogged down by the calls.
I walked around my office and asked every colleague I met to make the call. The last 5 people who called, the person answering the phone rudely asked them to call the local Congressman's office instead of the Representative's office. He did not take any information nor did it look like he was making a note of the call.
Any pointers, information as to what may be happening?
I am not sure about the rude part. All the posts in the 12 pages have actually appreciated the patience of the caller.
Some answers on why you are calling Rep Smith even though you are in a different constituency. Send the first post of this thread as supporting material to those who are going to call. It hardly takes a min to read that post.
(1) Yes, we called our Rep and asked for support
(2) Rep Smith is the ranking member of House Judiciary committee and thats why his support is crucial to these bills
(3) Rep smith championed high skill bills in the past and these are common sense measures that will increase American competitiveness

I could not believe it either. My PD is August 2003 and EB3 from India. I have read many stories where people seem to have got GC when their PD is not current. In some cases, it appears they keep quiet about, but in some cases people seem to have corrected the situation to avoid any future complication, for example, if one decides to become U.S.Citizen at any point. It is just frustrating to think that I probably need to spend a lot of money on an attorney and go through the mental stress in resolving this because of probably an error some foolish clerk at USCIS made.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.
Well.. :) Look at it from the positive side. It may also mean that your I-485 application is going to take less than a year to approve. (According to USCIS, 2-year EADs are going to be issued only to applicant whose I-485 approval is expected to take a very long time, e.g. more than a year.)

Why not file on your own??? they charge a ton ... heck you could buy an iphone with service for a year with what they charge ....the quote they gave me was :

A good attorney should be able to get those who availed themselves of the AC21 opportunity free and clear in their green card journey. The law seems pretty clear on this to me.
This is clearly a big deal for much of the IV community, who are stuck in this process due to inadequate EB visas and inefficient immigration service center processing.
I believe this might end up needing a class action litigation (for violating AC21 law) and an immigration attorney could make a name for him/herself in the process of this case!
Witness Carl Shusterman's challenge of the USCIS's erroneous interpretation of physician NIW laws and his subsequent stature in the field.
If there are adequate numbers of you, which based on this thread there seem to be quite a few, then approaching a good lawyer to represent the group pro bono and getting this mess sorted out for good might be a consideration.
Any thoughts?
