Unfortunately only EB(I) will be able to associate with this, so apologies in advance to others.
It's 2018. Two indians, namely Ajay and Vijay meet in a grocery store aisle. Ajay inadvertently drops a carton of tea and Vijay try's to help pick it up. They exchange nicieties, shake hand and WHOA... Ajay noticed that Vijay's got a big EB2 tatto on his forearm...Without a moments delay, Ajay folds his sleeve and shows his own EB2 forearm tatto to Vijay. Ajay and Vijay become friends forever....
On the same evening.....Seeta and Geeta are shopping for tamarind in a nearby aisle....for some reason (I cant be more vivid than this) they notice eachothers tatto's; one has EB3 and one has EB2..........CATFIGHT!!!!!!!!!!!!!!!
Morale of the story : Lets stop the drama and get busy helping ourselves..if you want the above scenes not to translate to reality....
Can't we all just enjoy lessons taught to us by Bollywood......If you have hard time coming to terms with the above scenes , please close your eyes and go back 30 yrs into

People were very happy with the last USCIS announcement but we all forgot about pain of people who are stuck in years of backlog. Though some of those unfortunate may have used harsh or improper language, but they had all the right to express their feelings. We all talk about Gandhian philosophy, but we need to be more tolerant. Before we ask to ban anyone from our forum, please try to put yourself in their shoes.

You nailed it man. As i said in my post yesterday what you described so well is exactly what happened and so my explanation of just 140 substitution was not accurate.
Please note the response I got from the attorney of my previous employer (the one who revoked)
This is exactly what I previously explained and what XX verified for you. The I-140 was revoked/withdrawn and the labor certification was substituted. If only the I-140 had been revoked/withdrawn then you would still be portable. However, as XX confirmed, the company used the case to substitute another employee.
Clearly the ex-employer and USCIS are at fault. I have the approved I140 and to date on my uscis portfolio it states that my I140 was approved in Feb 2005. I changed jobs in June 2006.
I am so &^^%$#@ tired, that if this does not work....I am going back. Enough is enough.

From your I-485 denial notice and reading some of your posts in this forum it appears that the underlying I-140 petition has been revoked by your previous employer.
I dont think they substitute it for some other employee, their is no such concept as using the approved I-140 of a individual employee to use it for another employee.
Theis is the possibility that they revoked your I-140 and used the underlying approved Labor certification for another employee, or if they have any grudge
or for some other reason revoked your approved I-140.
If you were holding an approved I-140 and changed your job after 180 days of filing your I-485, then you have good chances of winning MTR.
Please consult attorney Murthy or Rajeev Khanna. I heard they are good at handling these type of situations.
Make sure you have the valid job in a similar profession as what your labor states and your are in legal status (H1B) with the current employer.
Technically you can not use EAD until they restore your I-485 petition.
Wish you good luck and hope you will have a successful outcome.

I am an EB-3 I and I do agree with lots of Eb-2 folks over here. Eb-3 folks can contemplate of moving on and apply fresh labor/140 and port to Eb2.

Now that sounds fishy and it looks like you are an admin or a donor who has access to the web page and are hiding under a junior member name named getgreensoon1. this confirms what i am thinking that all that psotive money posts were all fakes and created by a few members like you to dupe the public into thinking you have such a big support. I came to know of this site last december untill I met one of the admnstrator who had come down here for a conference.Since then I have advocated this site to so many people and in my company its a Fortune 500 company we have lot of diverse memberships like Indian ,Chinese and various other countries memberships in our company.In our indian club we have about 100 employees of indian working for this company.Apart from circulating the site I have made it a policy of calling up people on phone every weekend and telling them about this site and work lying in front of us to get it done this year.
Do you think that I am helping this site or the IV core.NO I am helping myself.So please be consructive and help the cause and help yourself.
