Immigration is the most contentious issue that I have worked on during my tenure in Congress. It is imperative that we first secure our borders and enforce our existing immigration laws before we attempt to implement comprehensive immigration reform. According to the Department of Homeland Security (DHS), just over 600 miles of border fence has been constructed along the Southwest border to date. In more remote areas, DHS is using tower-based integrated cameras and sensors, ground-based radar, mobile surveillance systems, and an unmanned aerial system. These initiatives are in addition to border patrol agents who are actively patrolling the areas.
I have consistently supported providing the Department of Homeland Security with the necessary tools they need to protect our country from those who seek to cross our borders illegally. For instance, in July 2009, I supported an amendment requiring the completion of 700 miles of double-layer physical fencing along the U.S.-Mexico border by December 31, 2010. This amendment follows through on the three-year-old promise made by Congress and the Department of Homeland Security to secure the border under previously passed legislation.
We must also address the illegal immigrants that are currently in our country. I will not support any proposal that provides amnesty or a path to citizenship for those that are currently here illegally. Additionally, I will continue to support programs like E-verify that provide employers with tools to verify whether or not current and prospective employees are legally allowed to work in the U.S. Since its inception in 1996, the E-Verify program has provided employers with a process to verify the work eligibility of new hires. E-Verify is free and more than 87,000 employers are enrolled in the program. According to U.S. Citizenship and Immigration Services, more than 1,000 employers voluntarily sign up to use E-Verify each week.
On July 8, 2009, the Senate passed H.R. 2892, the "Department of Homeland Security Appropriations Act, 2010." Included in this bill was an amendment, offered by Senator Sessions, which removed the sunset date on the E-Verify program, and requires federal contractors to participate in the E-Verify program. With my support, the Senate passed this amendment by voice vote. This program began September 8, 2009, and requires federal contractors to use the E-Verify system to check the immigration and citizenship status of new hire and those assigned to new federal contracts.

After thinking about it, I feel very very sorry for disrupting the cheerful atmosphere on this forum. It is time for champagne, not complaints. This should be a place to congratulate and applaud IV's achievements, instead of that to express one's own frustrations. People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.
Please do not list what you have done to add items in the legislation to help BEC victims, it does not look genuine any more when it is considered disruptive to express one's depression on a board specially for BEC victims.

But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me.

So if someone has sent "X" no. of faxes through IV or contributed by actively and noticeably and is recommended by "X" no. of people they should have access to paid forums for a defined timespan (eg. earn 1 months access by sending faxes) Letters are not really verifiable so not adding this here. Going the earned path would not alienate many members who may not have contributed recently - but nevertheless are still contributing otherwise. People who have contributed in the past can be retroactively given access for a month for every $25 they've contributed.

On June 27, 2000, the Department of Justice published a regulation in the Federal Register (at 65 FR 39513) concerning professional conduct for attorneys and other representatives (practitioners) who practice before the Board of Immigration Appeals (BIA), the Immigration Courts, and the Department of Homeland Security (DHS) (formerly known as the Immigration and Naturalization Service).
The regulation, which was effective on July 27, 2000, explains procedures for filing and investigating complaints and for conducting disciplinary proceedings against practitioners who may be subject to sanctions. Its purpose is to protect the public, to preserve the integrity of all immigration proceedings and adjudications, and to maintain high professional standards among practitioners.
This fact sheet outlines the major regulatory provisions and answers certain questions that may arise among prospective complainants and practitioners.
GENERAL PROVISIONS
This professional conduct regulation applies to every private immigration practitioner authorized to practice before the Executive Office for Immigration Review (EOIR) and DHS (including attorneys, accredited representatives, and law students, among others). This rule does not apply to Government attorneys, such as DHS trial counsel, because they are subject to separate regulations and disciplinary procedures.
Agency Jurisdiction
Each agency has jurisdiction over practitioners who appear before their respective tribunals. The Office of the General Counsel in EOIR will investigate and prosecute ethical complaints against practitioners involving alleged misconduct associated with practice before the Immigration Courts and the BIA. DHS will investigate complaints involving alleged misconduct associated with practice before DHS (e.g., asylum, adjustment of status, visa petitions, etc.).
Disciplinary Process
Any individual who believes that an immigration practitioner has engaged in criminal, unethical, or unprofessional conduct may file a complaint with the agency with jurisdiction (EOIR or DHS). The complaint must be in writing and include relevant names, dates, locations, and other details sufficient to clearly identify the offending conduct or behavior.
Upon receipt of a complaint, or on its own initiative, the agency with jurisdiction will conduct a preliminary inquiry to determine the merits of the complaint, informing both the practitioner and the complainant of any action taken. The office will dismiss without further action any complaint that is found to have no merit. The office may close a preliminary inquiry if the complainant fails to cooperate or provide reasonable information or assistance. During the preliminary inquiry, the complaint remains confidential unless the practitioner waives the right to confidentiality.
Hearing and Appeal
If a complaint is found to have merit, the agency with jurisdiction will issue a Notice of Intent to Discipline (NID) to the practitioner. The practitioner must respond to the NID within 30 days and may request a hearing. A practitioner’s failure to respond to the allegations in the NID in a timely manner may be treated as an admission of misconduct and a forfeiture of the right to a hearing. The BIA will then issue a final order imposing the sanctions recommended in the NID.
If a complaint about criminal conduct is found to have merit, it may also be referred to appropriate investigative or prosecutorial authorities within the Department of Justice or DHS. Complaints about unethical or unprofessional conduct may also be referred to appropriate local government or licensing authorities.
When a practitioner requests a hearing, the Chief Immigration Judge will appoint an Immigration Judge as the adjudicating official who will conduct a hearing and render a decision in the case. The adjudicating official shall not be an Immigration Judge before whom the practitioner regularly appears or who has intervened as a complainant or witness in the matter. The disciplinary hearing generally is open to the public.
Either party may appeal an adjudicating official’s decision to the BIA within 30 days. The BIA will conduct its appellate review of disciplinary decisions in the same way it reviews appeals of decisions in immigration proceedings. Final administrative orders in disciplinary cases are also subject to Federal judicial review.
GROUNDS FOR IMPOSING SANCTIONS
Disciplinary sanctions may follow if, among other things, a practitioner has been found to have engaged in conduct that constitutes a violation of one or more of the following grounds:
Charging a grossly excessive fee;
Engaging in bribery or coercion;
Knowingly or with reckless disregard makes a false statement or willfully misleading, misinforming, threatening, or deceiving any person;
Soliciting professional employment – a practitioner is prohibited from distributing solicitation material in or around the premises of any building in which an Immigration Court is located;
Is or has been subject to a final order of disbarment or suspension, or has resigned with an admission of misconduct, by any State or Federal court;
Knowingly or with reckless disregard makes a false or misleading communication about qualifications or services (e.g., practitioners must be recognized as certified specialists in immigration law in order to refer to themselves as such);
Engaging in contumelious or obnoxious conduct;
Has been convicted in any State or Federal court of a serious crime;
Falsely certifying a copy of a document as being true and complete;
Engaging in frivolous behavior;Engaging in conduct that constitutes ineffective assistance of counsel; and
Repeatedly failing to appear for scheduled hearings in a timely manner without good cause.
IMMEDIATE SUSPENSION
Provisions in the regulation permit the BIA to immediately suspend a practitioner who has been subject to either disbarment, suspension, or resignation with an admission of misconduct, as imposed by a State or Federal court, or conviction for a serious crime (including any felony). Thereafter, a summary proceeding will be conducted to consider imposition of any final discipline.
REINSTATEMENT
A reinstatement procedure will permit a practitioner to regain authorization to practice once his or her period of suspension before EOIR has expired or, as provided in limited circumstances under the rule, when the period of suspension has not yet expired. Prior to any reinstatement, the practitioner will be required to request reinstatement with the BIA and to provide evidence of good standing in his or her licensing jurisdiction.
FORMS

This is certainly good news for many. However the skeptic in me is feeling very uneasy. Why did they suddenly open the flood gates? Did they purposely create a backlog and then increase the fees (double the fees) just in time? Are we going to face other issues down the line after applying for 485?
I guess for now, we will just celebrate and try to get our 485 applications in before July 31st. After that it is a wait and watch situation.

Major reform is "not viable in this Congress," added Rep. Zoe Lofgren, D-San Jose, chairwoman of the House Judiciary subcommittee on immigration. (http://www.dailynews.com/news/ci_7437469)

I am generally a very optimistic person but not seeing whats really viable this year.
I understand that IV is looking into other angles as well. Once again not sure.

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...

I applied for tax return with my cousin as dependent. I am H1B on a project working for MNC, spouse in H4 and my cousin is doing his MS on F1. Since my wife has only ITIN, my understanding is that there is NO stimulus payment for me and my cousin will loose his $300 as he is claimed as dependent. last week, my cousin got a letter from dept of treasury that his stimulus payment is on the way and sure enough, couple of days later, a check for $300 is waiting for him.
Is this normal that a person with a SSN who filed his return as dependent get stimulus benefit? just checking if anyone else got one like this.. does this mean I can expect $300 for myself being on H1B with SSN also?

Experience with Air India
It is with great shame I bring out this piece to you about how Air India is using the "India" tag by cheating its innocent citizens and show its ugly real face. I have never seen anything so unprofessional and have no hesitation to say they are the worst airline in the world.
Passengers:
Father-in-Law (FIL) and Mother-in-Law with baby
My in-laws were returning to India via Air India on September 24th from EWR (Newark, NJ) airport after brief US visit.
Ticketing Experience:
We started the whole process 1 month earlier and contacted Air India (1800 223 7776) about the booking. First we got an answer saying that the class we booked in is full and we have to pay another 40$ per person for another segment. For that we had to call another AI booking# and after 40 mins on the call could reach an agent. We
got new confirmation #s and when asked for the basinet seat was told they could not see the seats and have a special request sent and asked me to call back in 3 days to confirm. We called like 5-6 times and everytime were told they cannot view the seats and when asked to see for seats in another segment or another date, we were told to
re-book again and then ask for seats. How on earth could an airline not see available seats in its aircraft.They have taken customer service to new digraceful level.I roped in my brother in law to go to AI office in Newark and try with an agent directly. Even after
going for 2-3 times directly to the AI office, my BIL failed to secure us the seats. After all the tries we were ultimately told to go to the Airport sooner on the travel date so we can get a basinet seat.
Journey Day:
On the date of the travel in-laws reached at 2:00 PM at the airport in hopes that they will get a basinet seat. The agent gave them a hard time and we had to go back n forth 2-3 times for getting the seats confirmed and have in-laws and baby seated together. I think the whole ticketing at the aiport is being handled by a third party who
are doing a horrible job. My FIL in the meanwhile buys a gift at the custom notified shops at EWR.The flight which was to depart at 6: 20 PM was ready for take off when all of a sudden the pilot says there is a technical problem (God knows what would have happened had the flight taken off). The flight returns to the gate and the passengers are told to wait until they fix the problem. They wait for 2 hours and are asked to then wait in the
boarding area until they really look into the technical problem. (In the meanwhile we hear on Indian TV channels that there is a Pilot strike going on in AI regarding Pilot pay package which adds to our tension). The Air India (airindia.com) website is for show off only with few flight images and had no flight status. We immediately call the AI office in Newark who have no-clue what is going on. When I asked the problem they said it is confidential and cannot be told:(. Eventually all the passengers are told that the flight has been
cancelled for the day and should return the next day and all the checked in baggage will be returned. My poor in-laws with baby had to return back and reached home at 3:00 AM in the morning.
The next day:
The next day the whole scene repeats again and we had to deal with the irritable AI ticket agents who say they are missing something at their whim. We were able to get a basinet seat this time also and happy we were all set for the 6:20 PM flight. This time we gave my FIL a pre-paid cell phone. The same thing repeats again. This time they wait in the boarding area and are told that the pilots have gone to repair the earlier (Sep 24) flight which had an issue. They wait patiently until 10:15 PM. We were all tensed here
and were expecting the flight to be cancelled this day also. No body from AI was available this day to pick-up and explain what is happening. The call re-directs to India who have no idea about the flight status in US. My FIL eventually calls at 10:30 PM and said that they will be boarding soon.
Frankfurt stop:
The flight has a stop at Franfurt and the passengers were asked to go to another terminal
for boarding the same aircraft. They had to go through the security check again and to my FIL's horror, the gift he bought at EWR duty free shop was not allowed and removed. When he showed the receipt they said that the gift has been bought in
US and cannot be allawed into the aircraft. :(Air India where are you and what a Maharaja experience.
Worst website ever:
In the mean while we keep checking the AI web site which I think is one of the worst web sites I have ever been to. I think that this contract is also being awarded to some third party with crores of tax payer money. we were looking for schedules of flight which departed on Sep 25 from Newark airport and here it shows th schedule of the 24th
flight.
Customer Service in Mumbai:
We tried to track the flight (if flightreached Mumbai) by calling AI desk in Mumbai. They had no idea and after repeated calls could reach an agent who made some research and
told that the flight has reached Mumbai and gave further schedule of the flight.
Flight reaches Hyderabad:
The flight reached Hyderabad after change of flight in Mumbai.
Luggage:
Some of the luggage was missing. To our horror the bags we got had stuff from some other people's bags. Please leave the luggage Air India.
Summary:
What a mess Air India. You have taken advantage of the "always yielding" Indians who prefer you for a home experience. Please remove the word "India" nd the "Maharaja" symbol as you are no longer fit for that.
Everyone makes mistakes. e.g. You are a veteran member (Join Date: Jan 2006) with IV and yet you posted this thread in wrong forum ..!!!

All we promote is from Core and dicussed with State Chapter leaders onlyIf your statement has been endorsed by the core that they want a million number then forget about this effort.I am feeling sad that i was part of this effort.I am not going to be part anymore unless i see some direct addressals from core to do it hence forth.I wish your million signature drive doesnt drive away many more like me.

I went thru posts on other forums with I 485 denials after 180 days of filing. In almost all the cases, people filed MTR and their I 485 was re-instated back to normal after that. You should be fine after filing the MTR with the help of attorney.
I know these 15-20 days will be hard for you. Hang on. I had the same experiance when there an RFE on my I 140.
I went thru posts on other forums with I 485 denials after 180 days of filing. In almost all the cases, people filed MTR and their I 485 was re-instated back to normal after that. You should be fine after filing the MTR with the help of attorney.

If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.
If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).
You do **NOT** need the $80 Biometric fee for the Advanced Parole.
