I read in some posts before that there were 18,000 Eb3 approvals in 2007. Is this true ? If USCIS is allocating unused numbers at the end of the year, then Eb3 India might move fast during the rest of this year.

I filed I-140/I-485 April 22 and received receipt notices. No appointment letter for finger printing yet and no LUDs. Texas currently processing date is April 28 for EAD. Sould I be worried?

Let me reiterate that I am all for H4s being able to work and you guys should try unite for this cause.
I haven't researched L1 quota and its intent so I really can't comment further with respect to that.
Its unfortunate that legals and illegals are measured on different scales and it would be very unfair if they end up getting more benefits than us legals. I am not sure what you mean by illegal spouses? Either one is illegal or one is not.
I wish you the best in your search and would highly recommend exploring the unpaid internship possibilites in the interim.

I got biometrics notice for an appointment in the past :mad::mad::mad:
So, I made copies of the notice and put together cover leter and asked to be rescheduled for Sep.
Will call next week to follow up. In the meantime I noticed soft LUD on the date of my supposed biometrics....but the online message still says document production ordered....
Total chaos guys....:mad:

Yes. If your visa is current in July. Then you have whole July to apply. Even if you deliver on Sundays. but i have no idea whether they accept application on Sunday's..
Now with this bulletin, is it not dates are CURRENT for the entire month of July?

If we stress on IV's acheivements .. eg. flower campaign & San jose Rally and outcome of these..Reversal of Visa Bulletin then I think people will try to understand..

EB2 dates may be unavailable/ dont move. But it is just for a very short span of time. And after that EB2 dates start moving quickly again. I presume by 2009 october, the EB2 India PD will close to 2008. Any retrogression, if ther is, in EB2 will be very mild from now on because of the spillovers.
Regarding EB3: Every year there had been about 100k approvals in EB3 category, out of around 160K(even though there are 140k visas, there have been approving more because they are using unused family visa numbers) approvals in Employment Based Category. This is because of vertical fall outs of visa numbers. Now they have changed the scenario to horizontal fall outs (spreading across at the same category level( ex. EB2) irrespective of country of chargeability.). So this time it would be around 100K approvals in EB2 category.
Let us make as much noice as we could because of EB3 retrogression. That doesnt effect EB2 movement. But may make it possible visa numbers increase for EB category by legislation. So we have to support this agitation made by our EB3 friends.
I could seee all the EB3 folks with PD older than 2006 and EB2 folks with PD older than 2008 will be cleared off in the next two years. Very good. If I can go, I am sure you can go too. If I can afford to buy some plane tickets, you can too. If I can take a day off, you can do it too. This little time and money is nothing compared to your next few visits to your attorney's office when is time to renew that I am sure you're tired of doing.
I want to do it for my family, you do it for your family and then educate somebody else so they can go too. Next thing you know, we'll be a lot and we'll be heard.
If you don't go to D.C. you'll feel bad when you see that we succeeded and you did nothing about it!!!! just taking a "free ride" All of us are enjoying the results from the flower campaign and the S.J. rally. So we know we can do it again.
When you get your GC faster than expected, you'll feel so guilty.
We'll be there, I want to be proud that I did my part!!!!!

Think about it, everyone can make it! We have already prevailed against so many odds! (The first of which was to get a job in the U.S. with so much worldwide competition for our positions). If people really want something they will do it! The key is to convince yourself that you want to go to the rally because you think it will be useful to you! (Trust me, it will, but you need to convince yourself! At least TRY!!!!) We can do this!!!

Got my approval but my spouse hasn't yet received one.
We e-filed it together through the same account. My LIN was constantly getting updated with the status but not my husband. I also received the notification when my application was approved. I got my approval in the mail today too (about 1 month turnaround time) .But we haven't received any notification on my husband's case. And the online status hasn't changed either. Did anybody else face this? Not sure how to follow-up. Any pointers?

Well, If you sign up for IV credit card, the contributor is not paying from his pocket. It's the bank, who is paying for him, and contributor will keep earning miles/reward point as with any other credit card so it should make ZERO difference for card holder.
Its like finding a advertising sponsor for any of the IV event,except this is one time effort.
the earning could be huge. lets do simple math.
Average CC monthly bill = $1000 , 2% of $1000= $20.
20 * 20k = 40K monthly contribution.
Now think how hard is it to raise 40K monthly using our regular fund raising ?
Basic problem with fund raising is, once person gets his EAD/GC , he stops visiting IV website, I am sure he/she still supports the cause by heart but it just happens that he does not visit this site and does not notice our fund raising drive ( and as a result, we call them selfish :p) .
But if he is carrying IV credit card , its very easy for him to pick up that CC and swipe every time he makes purchase and support the cause.

"thank you for calling blah blah in order to blah blah we may need to ask you blah blah blah" and 5 minutes later they ask you like, 4 questions. She said no, she likes her job. I'd say that too if I knew there was a chance the conversation was recorded, as their phone messages say. Now I just interrupt and go "You're welcome, and NO, not in the military, YES it's about an i485 application, NO it's not about an appointment, YES I have a question.

07/21/2007: RFE/NOID Flexible Time Frame Rule and Need for USCIS Discretion for Pe-July 17, 2007 EB-485 Filers
July VB Fiasco was a tragic event in the American immigration history and we are grateful that the USCIS rectified the problem on July 17, 2007 by reversing its decision to deny July 2007 EB-485 applications. We do not have specific statisics on EB-485 filers from July 2, 2007 until July 17, 2007. However, for the two reasons, among others, a large number of applicants sent in EB-485 applications during the period. Firstly, they more or less anticipated that either DOS or USCIS would rectify the problems because of the potential serious flaws in their decisions. Secondly, AILF was preparing class action lawsuits and they wanted to make it sure that they took advantage of being a member of the class without actually being named as plaintiffs. One time, people thought it was a smart move and right thing to do it, even though this reporter suggested to the people to wait until August VB was released.
Currently, these early filers are literally going through nightmares, hardships, and sleepless nights because of the two reasons. The first reason is that their cases have been on hold and no Receipt Notices have been issued. The second reason is that recently the USCIS revised its rule (1) allowing the adjudicating officers to exercise a discretion and issue a RFE with the response time of less than 12 weeks and (2) to exercise a discretion to either reject or deny a petition or an application without issuing RFE when the "initial evidence" is missing in the filing. Combination of these facts is currently creating a turmoil to these filers for the two reasons. There are some filers who submitted I-140/I-485 application without a sufficient documentation in haste, for instance, medical report, or other flaws in the submitted evidence. These people are restless not knowing whether their application could be rejected or denied, indeed a truly deadly consequences. The circumstances force them to wonder whether they should refile the petition/application before August 17, 2007 not to take any chances. There are, however, two hurdles to such decision. One is the recent denial of I-140 petitions by the adjudicators if the petition was not accompanied by the "original" labor certification. The another reason is no fixed rule or policy on the filing of multiple I-485 applications. This creates a fear that their second filing may also be rejected or denied. They are thus trapped! The second victims are international travelers. If the application is either rejected or denied and they are present in the U.S., they will be able to refile it after correcting the flaws in their initial evidence before August 17, 2007. However, when they are not present in the U.S., they will be deprived of such opportunities, which may be considered "deadly." Some people are still present in the U.S. at this time, but because of business or personal emergency, they will have to travel outside of the country using their H-1B/H-4 or L-1/L-2 visa. If their cases are rejcted or denied during their absence, they will not be able to refile it timely before August 17, 2007. They are trapped again! Their act which was considered a right thing to do to one time turns out to be a nightmare. Who would have anticipated the nightmare?
We urge the USCIS to consider the following actions to relieve these applicants from the unnecesary hardship:

Accordingly, it should be a matter of adhering to the tradition and to instruct the adjudicators not to reject such refiling on the issue of a copy of the certified labor certification application. Additionally, inasmuch as there is an evidence that the labor certification has been certified by the DOL but the applicant was unable to submit the original or copy because the application was lost or yet to be delivered to the applicant, such I-140 which was filed during the period should not be rejected or denied. Again, it has been a tradition of the agency to request a duplicate certified labor certification from the DOL by the agency itself when there was a proof of certification. We urge the USCIS to exercise the discretion and instruct the adjudicators not to reject or deny I-140 filed during the problem period for the reasons of missing "original."
Foregoing actions will relieve these filers from most of the nightmares or status of being trapped. It is thus strongly urged that the leaders of the USCIS extend a compassion on a human level and exercise a discretion immediately to take the foregoing actions. This reporter has been receiving hundres of emails from these filers and had to share the pains and emotional despair since there was no answer to the foregoing issues under the curcumstances. Since the deadline of filing is August 17, 2007, the USCIS should swiftly release an announcement to relieve these people from the problem "effectively." On behalf of all these trapped, this reporter personally pleas the leaders of the USCIS to act quickly.
