    I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
    From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
    With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
    We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
    Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.
    I dont care what or how many reds the EB2 folks give, but the fact of the matter is that we EB3 must join hands.

    If you think you are qualified for an EB2 job why don't you apply for one and get another labor/140 filed rather than crying "Sour Grapes"? Get out of your comfort zone and try getting a new job. Simple. If you have been on an Eb3 since 2004, that explains your "Go getter" attitude. Be smart dude.

    Remember that you have to be in the country to apply for I-485.

    Is this true for Consular Processing applications as well ? I thought CPs are filed at the local US consulate (Mumbai in our case). Additionally, I have a question about I-485 - CP filing and retrogression. Once we file the 485, does the CP get stuck in case there is retrogression in a few months time or is it that once we have applied the process keeps going ? Thanks in advance for the information.

    I know IV is doing its best and there are other groups fighting for HR 5882.

    But honestly, what are the chances for this bill to succeed this year (before election)?


    -- The July 2007 visa bulletin reversal.
    -- FBI name check
    -- 2 yr EAD

    These are all changes that happened because people brought it to the attention of lawmaker and administrators. Before I get complaints, I am not saying IV solely gets credit for it. Whatever the mechanism for change, it happened because the immigrant community worked together and fought to get relief.

    We have to continue to work together, otherwise its status quo and be stuck in the mess.

    I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.

    In fact, I also thought like you. I decided to do an MBA , so out of that 3 years 1.5 years were used up by my MBA.

    Hello,

    I'm also in the same situation. My labor is approved May 2007. I'll need to apply for both 140 and 485 together. Can I do it at the same time ?? or do I need to file my 140 immediately and then 485 after a few days. Time is running out now, as we never know when USCIS would again stop accepting 485s. Please advice.

    Canada does not have 50 universities, in TOTAL. So your choice is limited to
    (1) Queens University in Kingston, Ont.
    (2) University of Toronto
    (3) UBC

    Well, that is not true. Canada does have 50 universities. Kingston, Toronto and Vancouver are not the only places in Canada. Besides many universities in Toronto area (McMaster, Toronto, Waterloo, York, Ryerson) other Provinces such as Alberta, Saskatchwan, Manitoba, Quebec, New Brunswick, New Foundland, etc. all have good universities. If you are a PR, tuition is very low compared to the US. If you are outstanding in your field, you can hope for a grant too.

    I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005

    This is not how you should have said, delay EAD for others just because people are struck at BEC. Comeon buddy show some wisdom, you should have said USCIS come out with a plan where as soon as BEC labor is cleared, they accept the applications for 485.

    Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.

    P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)

    SATYAGRAH is an Excellent idea.One day hunger strike near Capitol hill will give enough media attention ! I think it is legal to protest in a peacefull way. It is much better than rally ! I am ready to participate in SATYAGRAH in DC !

    Keep aggressively working on SATYAGRAH (insist for truth) to end retrogression. If nothing happen in lame duck session, I would suggest to gether at DC (may be 50-100 people) and have one day hunger opposition. One person can dress like Gandhi to attract attention of media.     There are two things we can do to fight for devil of Retrogression. Similarly Mahata Ganghi did for Independence

    1. Release stress, frustration, negativity encounter to all of us due to retrogression. Positive points are highlighed in this thread by many friends. Mahatma Gandhi also did the same to overcome enger, frustration of millions of people.

    Yes, I used to say like this five years back when I had time and age in my hand. I assume you are in early or mid 20's. I will put it differently for you.

    Assume there is a big pond which starts from 1 feet and gradually increases up to 100 feet. People with one year work experience steps 0.5 feet. There are life jackets(GC) floating around the pool and whoever is lucky is picking it up. There are guys like me who are already in 5th-6th feet deep without finding the lifejacket, but we are sure if we go further, may be 3-4 feet more we WILL find it. There are guys who are lucky to find a life jacket at 1,2,3 feet also and happily float to the shore passing us. The fifth feet guy is practically seeing how the 6th and 7th feet guys are struggling. May be they are seeing some one in 8 feet to 10 feet. Now a big Tsunami (retrogression) comes and drags all the jackets 20 feet down further. These guys are dejected and some of these guys even pull their spouse/kids in one hand when they float/swim.

    Dont forget, it takes one year to step 0.5 feet. Every year the pond management drops a fixed number of jackets. These guys keeps their hope alive based on the above fact. But these guys are seeing some kids passing in motorboat(LC Substitution) paying that guy 10K and getting a life jacket. Hmm pain, but even if I had a chance I would have also done it.

    Now comes your saying. When the deepest s...t guys talks about their fate down the line and how to take their family safe ashore, a guy at 0.5/1 feet shouts saying "Dont give up, it is like deciding to take a sanyas because you are tired of dealing with social issues".

    If you are in 5+ feet, I take your statment. Otherwise, you will not understand what I am trying to say until you reach 5+ feet without finding a life jacket and also pulling your family in one hand and seeing your seniors struggling more in 8+ feet. :)

    I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.

    Going back to home country only because of the shortcomings of GC process is like deciding to take a sanyas because you are tired of dealing with social issues. I belive a decision to renounce something should only come from a position of strength. A true jogi is one who understands the triviality of society and decides to rise above it...not the one who denouces it because he can't deal with it.

    As the saying goes..its darkest before the dawn...I truely hope this is the case for all of us here...

    If some one has applied for labor substitution for a better PD and I-140 a week back and wants to now file I-485 without the I-140 reciept. I guess the advise was that one can go for it. The question now is as the I-140 was filed a couple of days back does he need to provide the employment letter which in this substitution case is difficult unless the new substitution employer is willing to give. In such scenario can one file I-485 with out the employment letter.

    Well thats our fate .. we are always forced to piggyback on a larger issue. With CIR it was illegal immigration, now it is H1-B. But you got to understand that if not for corporate lobbying (who have a heavier stake in H1-Bs) this bill would not have seen the light of day, that too in the house. We got to be thankful we are at least not being treated on par with the illegal aliens .. the broad theme of this bill is highly related to skilled immigration, which is much less controversial than granting citizenship to illegals; not withstanding the tancredos and numbersUSAs who will still be yelling doomsday from the rooftops. Granted we are flying under the radar as usual, but I very much doubt this will be an H1-B only bill without any EB relief.

    I agree, lacking enough "pull" either monetarily or numerically puts us at a disadvantage. However, I just read this post from indianindian2006

    It clearly says that there are provisions to address issues for permanent residency. Two that interests me and most others are:

    1) Exemptions for U.S. educated foreign workers with master's or higher degrees from the H-1B and EB green card quotas so their talent can be retained in the United States.
    2) Exemptions for EB green card immigrant spouses and children from the annual cap, thus making more visas available for the innovative professionals we need.

    So hopefully all is not over yet :) ....

    I called the USCIS just now, and they told me that they can tell the receipt number to ONLY my attorney or my employer, provided its already in the system. I filed on July 5 ( NSC), and hasn't got the receipt number yet. There is only one person in my company to handle hundreds of GCs, and the person is very busy processing all these I-485s, and will not pick the phone for any enquiries, no reply for emails etc. so i am stuck! so i dont know whether they encashed the check or not!

    if u say u r the employer, then wat questions do they ask to verify that u r employer. i think they ll ask the questions from i-140 form only.

    Rally agenda - from the start, the D.C rally has not seemed need-based rally. San Jose rally and flower campaign were need-based. They were needed because USCIS ditched all July hopefuls. We were aghast and speech-less. So there was that burning-sensation in our tummies that took us to streets and greet the USCIS chief with bloody flowers!!

    i guess you need durbin grassley to return before the "burning feeling" is back. never fear, it's just waiting....btw were you in san jose? when have you been on the streets? who is "us"?


    D.C rally has been strategic one. Somewhere in the beginning of the game, we pushed wrong buttons in marketing/selling the strategy or signing up people for the D.C rally. I remember very very few messages on the rally forums and tons and 100s of messages on "July 2" forum.

    and whose fault is that? are the core members and other leaders of iv babysitters?
    we should now be responsible for spending our remaining life's time explaining why it's important to do something about the mess we are in? oh wait! we did! and copped a ton of abuse for it. go back and look at your posts and everyone else's on the July 2 thread....who has to put the posts on rally threads and not on July 2 threads? who exactly are you blaming here?
    and who is "we"? what role have you played?


    All senior fellows and the 1000+ members who made it to rally - have you surprised why there is NO 5000 - 10000 attendance.

    the registration was actually 2,000. and no we are not surprised. the sheer apathy of those that would benefit from this action and the obsession with receipt notices made it quite clear we were never going too exceed this number. we know that their are many like you here that want us to come to your house with a begging bowl so you can associate handles with real people without lifting a little finger yourself.

    thankfully there are 2,000 others that know they are doing this for themselves .

    Some more pointers to my thoughts -

    and? would you like my ss no? those who came to DC have solved this problem. others solved it long ago by getting involved and taking responsibility and sharing burden. it's yours to deal with now.

    there is a core team, and there are iv- chapter leaders. join your state chapter if you can drag yourself of the tracking threads and meet the leaders. i got to know real people because i pm'd them then e mailed them and called them, set up a state chapter and met them...
    nobody is going to put food in your mouth just because it is open. we are volunteers who give up a lot to keep iv going. we too have commitments at home and work. and they are as important as yours. the only difference is that our sense of self importance is a little less...

    this is hilarious. aman kapoor the visible founder and leader got his green card just recently. and he is not the only prominent or visible leader to have got it. what does green card processing have to do with exercising your rights to petition government? did you read what siskind and murthy wrote? would they ask their clients to jeopardize their futures? for the record, the 485 asks what organization you are a member of- and i am a member of iv- and i wrote that.
    it's a legal, registered non profit org. what's to be ashamed/petrified of?
    this seems to be your real problem, the rest is just a cover up.

    there are clearly many people with very genuine reasons for not being in DC. and that will always happen with any action. but we are 23,000+ strong. and you are benefiting from our actions per your own words. yet you lurk on tracking threads and then wonder why there are more posts there then on rally threads? wow...rocket science for the highly skilled!

    franklin! i begin to think this thread is pointless. those that have genuine reasons do...people like mhb, susie, sunny and madhuri will participate when they can. others like rajesh (can't associate the name with a real person btw ) and inskrish revel in being armchair critics. they will only be genuine participants when it comes from inside them. meanwhile we have to suffer their petty complaints and feel like we owe them something. (!!!!!)
    rajesh was in the DC area!!!!! and he chose to see other "attractions" on tuesday. you see it was not "need based". hilarious...but gives me heartburn. let's please close the thread.
