While I clearly do NOT agree with the original basis of this thread, here are the facts as I see it:
- We have an immigration backlog that affects a huge community and several people are only waking up to how serious this issue is (I will count myself in this category)
- IV has made significant contributions towards espousing our cause through the proper channels (via the press and lobbying)
- There is therefore greater interest today in an organization like IV and a desire to be part of the process including potentially financial contributions
- Hoewever, a lot of the new folks are looking for direction and a sense of belonging and action
- IV's policy of limited information dissemination (due to arguably valid reasons including the desire not to reveal any strategies to opponents of immigration) is not engendering the confidence required to welcome new members.
- An appeal for blind faith instead is just off-putting to most logical and thinking members and threads like these are nothing but an appeal for more information (stated rather poorly, I am afraid).
- In order to succeed, we clearly need to get everyone united
The reality is - IV needs a lot lot lot funds,IV needs manpower, IV needs your skills, IV needs your unity, IV does not need your criticism because if you criticize IV it won't help you.
So you and I together - united we stand - we build IV - if we do not want to take that extra step - we all suffer...............

In fact, with Obama's administration at least ready to talk about immigration, I think we have the perfect opportunity to get our point of view across through lobbying, which as you have said, will take a lot of funds. However, that said, is it really hard for the current team to undertstand that there are a lot of folks out there who want to contribute but would at least like to be informed on what is going on? I completely understand that those who are working hard on our cause don't really have the time to update others, especially given everything else in life they have to deal with. However, when there are people ready to take on this task, why the hesitation and the defensiveness in sharing information? We really need to move involve more people in this effort to have any chance of succeeding. I know a lot of folks have said something to the effect "it's not our job to inspire people - if they cannot be inspired to contribute, let them go to hell". However, I do think it's the job of leadership to inspire and get more people behind them or else no one will succeed - I really wish the Core team moves in this direction.
Disclaimer: I am a recent "Donor" and have certainly not put in anywhere near the amount of effort or money that several of the committed members like you have

Hi pd_recapturing, I am glad you understood my post clearly. I understand your point as well. Determining whether a company/employee is indulging in fraud or not is quite difficult if not impossible. I would suggest we start with reporting companies we know people work for and have negative experiences/comments about. It would mean reporting them based on anecdotal evidence but what else do we have as a starting point? I also know website reviews might not be very reliable since some disgruntled employee might post exaggerated comments about a company which might be following all the rules. But in general, we do know from colleagues/friends their experiences about employers who have sketchy credentials. Even TCS, Infosys indulge many times in L1 fraud as I have noticed. All I am asking for is better scrutiny by the USCIS at an earlier stage like PERM so such fraud applications can be removed.
I do not wish the genuine employees any ill will (certainly not) but I would like the fraud ones out of the system. Let's brainstorm more and we might have some success in cleaning out the queue of such frauds. Thanks for your insight.

But still the good news is everyone would be able to get their EADs and escape from the clutches of H-1B renewals and restrictions of remaining with the same employer etc. It's freedom to work anywhere! Doesn't matter when actually the I485 gets approved, until then you're free of H-1B tension at least. This is a big leap forward.

I would bet my chances with H1B rather than EAD. I myself is on EAD since 3 years and know the issues in getting the renewal on time. EAD will help those spouses who are on H4 to work but the circus will continue until the final approval is received.

We have seen in the past years EB3 ROW got huge visa bonanza at the cost of EB2 I & C. And now apparently EB2 I & C is getting rightly deserved visa bonanza.
How about asking DOS to give similar visa numbers to EB3 I & C as a one time exception. I know people will say it is against law, but in my opinion law is fuzzy enough for this to happen.
DOS can give explanations like "Visa numbers will be given to oldest PDs or some thing". Per my calculation EB3 I needs 68K visas to move past 2003.
We (IV) may have to make representation to Secretary of State and try and convince her.

First of all, the interpretation of the new provisions itself is subjective. Different interpretations, corrections, amendments to interpretations, etc will lead to another mess, after the provisions pass into law. As you already know, IV volunteers are currently researching on the hard country allocation issue, which may arguably worsen the retrogression for Chinese/Indians.
Let us assume that we are still able to pass the final provisions including the provision for amended soft country allocation. Imagine the number of applications that will flood the USCIS if the priority dates are adjusted to allow for all the eligible applicants. Do you foresee another backlog formation similar to the backlog centers that were formed for reducing labor applications and the mess they are in, currently?. Please note that the staff for USCIS will not increase, atleast for the next 1 year, until they figure out the volume of applications created with the new law and identify the magnitude of the staff shortage.
Even though I do feel that the existing retrogression will ease, if the provisions under consideration are passed into law; however USCIS will still keep some form of retrogression to control the flow of applications, especially for the EB3 category. In such a scenario, it is preferable that the USCIS allows the 485 filing and provides the EAD. EB3 applicants will be better off knowing that their 485s/EADs are in process/available, while waiting for the GC. So, even if the Eb3 applicant has to wait for 2-3 years (instead of the current 5 years) to get his final GC, he is atleast not dependent on his current employer.

Because of the country quota what you have said below is applicable to only people from India, because of the tremendous competition from Indian applicatants you would need the highest points , ms or phd, 5 years experience, employer sponsorship, and also relatives, but if you are from non Indian countries then you will easily get it because there is not much if any competition.
For example people from India might need 90+ points to have any chance but people from other countries might need just 60 points to get in. This is not merit based system, it is Kennedy Diversity Visa disguised as merit system.
I have one question regarding your view. Actually point system gives points to the US experience and employer sponsorship. Because of limited number of greencards Those who are not having both of this may not be able to get green card. If you give your calculation everyone will get clear about. I think MS with 5 year US experience will get more points than fresh Phd. That serves the purpose. If that is the case then only eligible people will get gc.
