Its just a matter that the Company felt that your skills require only a bachelor's degree for the work that you perform, whereas other companies feel it requires a master's degree.

I think its time to stop this discussion. It is pointless and self serving. We are all amazingly beautiful, intelligent, strong and sexy. Some are beautiful, intelligent , strong ,sexy and EB2 while the rest are beautiful, intelligent, strong, sexy and EB3.

It's official guys, we ROWs only argue for the sake of our self servient morality or lack thereof, while all others are on a Utopian conquest of fairness..
Never mind, good luck to everyone and sorry for time wasted thinking we were having a conversation
Good bye :)
That's quite a dumb inference.
Dude, what's wrong in admitting a bit of selfishness here?
All of us want something in the end, and that's why we're here pooling our needs together. Nobody's asking you to be selfless.

Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?
I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They dont pay from their pocket for GC (ideally correct). None of them has clue about priority date etc.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I dont think so but some one can confirm if they had experience otherwise.

Flower campaign wasnt started by iv (atleast not by the seniors), it slowly gathered momentum on its own and produced results. After seeing this bulletin I ve lost hope in all this lobbying and stuff. We need publicity and more of it. Fasting for a day if organized by iv could bring more results.

whats with the quotes...comparing to Gandhi and Martin Luther King Jr...Please dont kid yourself.
They did it for their country and fellowmen to be free from the clutches of oppression (a much serious issue than green card i think). Although even that is extended selfishness (cos of being Indian or African American) but they dedicated their entire lives for that cause.
We are not even close...this is just for MY GREEN CARD!
am i wrong?
Don't you think you are not free from the clutches. If getting some green card relieves so many people from clutches why not fight for it?

Guys, this is by far one of the best points ever made in this forum. This is actually our silver bullet. Open the eyes of people around the world that the US is not treating skilled immigrants right anymore. There are many countries out there which offer more career opportunities than here. By the way, what am I doing here?!
Pappu, I sent the article to my cousin in China, asking him to publish his story. Please read his reply. He graduated from University of Chicago and went back to China two years after working in US.
"This is another sad story about skilled immigrant.
I want to talk about this issue from my perspective.
I got my M.B.A in a prestigious US university and worked as a Financial Analyst in US for two years. I was thinking of applying for GC at that time because I had planned to stay in US. But, that winter, when I took a vacation in China, I decided to look for a job in China because I was very impressed by the economic development in China and wanted to capitalize on the opportunity. The Chinese market was/is in urgent demand for US-trained financial analyst. After some interviews, I got a very generous offer from a multinational company and quitted my job in US without any hesitation.
Now five years has passed. Because of my excellent performance, I get two promotions in the past five years and am a director in my company. My boss, who is an american, lost his job and has to go back to US because my company cannot see any fiancial advantage to hire him anymore. I have never been happier. I believe that I made a very good choice five years ago. Most of my chinese classmates during MBA study are still struggling for their GCs and get stuck in their career development because of GCs. They are quite regret that they did not come back to China back 5 years.
So what I want say is that, US is not a very good place to stay anymore. There are many golden opportunities in your own country! Many countries are becoming stronger and stronger. It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

Look, i sympathize with you but you SHOULD HAVE poured in some money to start a parallel PERM application ..... PERM started from APR 2005 - you got almost 2 years +
My case is also like you but my Labor was 2 years old and applied just
before PERM and it went straightway to Phily Backlog center ... I thought
of applying for a Parallel PERM but mine was a RIR ( quicker) and Phily was saying that they would clear all Backog by SEP 2007 ( another 2 months)
Did you check your status in Backlog tracker ??
http://pds.pbls.doleta.gov/
Sometimes it does not depend on you, I am in Backlog due to my company's lawyer does not want to file for PERM  . Anyway I am changing jobs and starting again but this time with PERM. :D

I talked to many representatives regarding my I 140 filing from yesterday.
This is what all msot all of them said.
Nebraska center is running behind with their schedule in generating their receipt numbers.
First all the applications go to the mail room. If everything looks fine with the application, the mail room people would send the cheques to be enchased. This normally takes like a day or 2. Then they send the applications to a different department where the clerk needs to put the information in the system and generate the reciept and mail it out. All this process should normally take, 5 to 7 days and Nebraska Center has a turn around time of 15 days.
But Nebraska center is backlogged a bit due to the numerous applications they recieved, till last week for I 140's. And a decision was made yesterday that, the Nebraska Center would catch up generating all the receipts by August 1st. (Thats what the reps told me). So everyone's receipt number who filed their I 140 by July 16th should be available in the system by August 1st(we wud complete the 15 days turn around time too). And if they get mailed out by then, we may recieve in a week or so, by Aug 10th.
So everyone will be good to go. Even if you dont get the receipt, your checks would be enchashed by then which will have a receipt number and you can call the USCIS office to confirm that receipt number (as they will have it in their system by August 1st) and just file by putting the copies of those checks.
Its not our problem that they delay the receipts.
But I hope that everyone will get their receipts by August 10th. So just chill out and relax.

... People in France speak in French even when they clearely see that the passanger does not understand French and has no clue to the happennings ....
.
That is the general norm of many countries and cultures except South Asia where people are so enslaved by English that now we have lost the ability to understand this basic norm of human culture. We are the only people (South Asians)on earth who take pride speaking in foreign languages particularly English and not speaking in our own languages. Europeans, Japaneses, Chinese, Americans, Canadians, Arab countries all take pride speaking in their own languages.

I said I am not defending IEEE....so where the question of praising comes?
I've read the document. IEEE is supporting "Immigration Visas" but not H-1B visas(temporary).
Can you shed some light what they meant by "Immigration Visas"?
It would be great if you can give us an example of some one coming on "Immigration Visa" and becoming a permanent resident and subsequently a US citizen.

Ive been laid off as of Friday last week.
My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.
I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.
My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employers clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.
Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldnt find an answer for this anywhere.
Also, can I take contract jobs for the time being?
I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.
Please post your answers, comments and suggestions.
Thanks!
As long as your job responsibilities are same or similar, your should be good to go. You are probably confusing between Labor Certification and LCA. If you use your EAD, you can work anywhere in the US. LCA filing is done for H1B and there you could specify the job location but not in a Labor Certification filed for the GC process.
