Please stop confusing people - there is no such thing as a H-1B transfer.
It is a misnomer. When you move to a new employer, the new employer files a "new petition" with a request to extend your stay.
If you wish to continue working for your current employer, you can do so.
Refer to snathan's post, he has summed it up correctly.
The original poster is good to go - all he has to do is inform USCIS that the never worked for the new employer, and therefore, there are no paystubs, w2forms, etc.

We are quick in jumping at each others throat for no apparent real reason ! Being part of a forum is sharing space with others, with those whom you disagree, and those who disagree with you. Argue logically, but don't make it a personal fight.

I agree CIR will be modified but our EB reliefs (for existing EB applicants) are not controversial (ilegal immigration reliefs and H-1B increase are the most controversial), right?
I hope there would be some form of CIR with EB reliefs that both Dems and President would agree on.

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.
That's a relief because I called them a few times recently and found myself having to explain "the issue" to the customer service rep. Ridiculous to have something as major as this happen and they don't properly educate their Customer service department on it.

dear hydboy77, after reading your posts, I agree with another member -- that you have totally different goals and concerns from the pre-application of AOS. It would be the best to start a new thread for your concerns, and leave this thread soles for AOS pre-application.
Getting rid of semilar\same job requirement is going to be as easy or as difficult as getting prefiling AOS.
Getting rid of same\semilar job is not semilar to getting to green card. If you are a software person then you can put a restriction that you have to work in a software related job, in the same way if you a civil engineer then you should work in the civil engineering field. But the way USCIS does same\semilar job is job code match, responsibilities match etc etc etc, the problem with this is it is a very grey area, it is almost like doing labor all over again. It has not become that bad yet but it will sooner or later, how many H1b rfe\denials did you know in the last 2 years, I bet there are more H1 denials in the last 2 months than the whole of last 4 years.
I understand you are not being selfish but why would anybody want to use EAD instead of H1 other than for getting rid of visa stamping purposes. The overwhelming majority of people are going to use EAD to switch jobs because of layoff . it's very easy to make assumptions of how the system works in this country when people want a solution that fits their own particular needs.
When people have been part of this society for less then 10 years; it is a very, very short time to understand how the system works and the whole history and what goes on behind the scenes.
Irrelevant and probably true for you as well. You don't need to be part of a society to understand how it works. You can understand it just fine by reading the literature produced by that society.
I've said this in the past; many people walk around with eyes wide shut. Do some really exhaustive work of the history of immigration; the debates that happened when the laws got created; what has passed, what hasn't; what uscis/ice/dol is doing; request for evidence, denials, consulate refusals; underbidding of contracts, etc.; you may come up with different conclusions then what you may currently believe.
It's tempting but also very naive to lay the blame for immigration restriction via the country quotas on abuse. My views on this were shaped after reading the history on immigration to the US and the literature put out by the anti-immigration movement.

Is there anyway we could go about pushing our story in the media? I am sure all of us combined have a a few thousand bachelor's, master's and ph.d. degrees. We are a group of people with highly advanced skill sets and this needs to be advertised. Maybe convincing a few journalists to take up our cause could be an option. I think it is important to maintain diversity in the overall immigration. However the immigration law has never resulted in achieving diversity. In the period 1900-1910, immigrants came from Italy (22%), Austria (20%) and Russia (18%). In the 1950-1960 period Germany provided 20% of immigrants. In the 1991-2000 period Mexico provided almost 22% of immigrants. In the FY 2005, Mexico provided around 161,000 immigrants (around 17%) of immigrants. It is easy to fix a quota for those immigration categories where visa numbers are limited such as for employment. However spouses and minor children of naturalized citizens have no waiting period. So it will be very hard to control the immigration percentages based on country of origin unless there is a quota for US citizen spouses, and children of US citizens wantin to immigrate!
The problem here is that we don't have a country quota for foreign students and H1Bs. Thus when these people try to become permanent residents then the quota's are applied and that is the core problem. My take is that country quota should not be applied for employment based immigration. Employers should not be forced in to an affirmative action plan but rather hire the right person for the job.

Suppose Company A filed for visa cancellation on 11th June, Monday. Please let me know if there would be any problem in filing for H1B transfer now as Company A has filed for cancellation before i file for H1B Transfer.
I have seen in other posts that you have about 2 weeks to get a new job who will file for transfer. But contact an attorney and if you cannot change job immediately then consider change of status to F1 or another status.
