URGENT HELP
Its a simple case. Its no company A, B, C and D and all applied for H1's or some vendors troubling me...so pls help.
I read all the posts on this thread but I dont think I got an answer I want. Here is my dilemma -
Scenario: I currently work for Company A. I interviewed with Company B and they are ready to file for my H1b transfer but they need me to join within the next 3 weeks. Today is Feb 6th 2008.
Question1) Is there anything like a H1Btransfer or is it a brand new application??
Question2) Does this H1B transfer go through the 65,000 quota system?? Is there a chance my H1B transfer can be rejected because I did not make it in the 65,000?
Question3) When can I start working for Company B?
Question4) Company B said that I should only inform Company A after I get a receipt from USCIS about my H1B transfer. If Company A matches up the salary what Company B is offering me after I inform them and I still havent started working with Company B, can I stay with Company A? If yes, What about the H1B transfer application by Company B?

My friend's wife is in a tricky situation. She has an approved EAD through her husband's I-485 petition.
She was working with company A on her own H-1 and decided to quit employer A and join new company B on EAD. At the very last minute company B has rescinded her job offer. She now cannot return to former employer A as well.
Is she in any status violation if she justs sits at home with an EAD but no job for a few weeks ?
Can anyone share their views ?

I do not see any issue here at all. Most of the housewives (including mine) and sons/daughter take EAD/AP and do not work. EAD is just an authorization, not a compulsion to work. Being legal here stems from the fact that her petition to adjust status (I485) is pending for decision from USCIS.

and few people asked me ' are you crazy? why you are doing all this for GC?'
Who said that, GC is minimum in this country to live a normal life, with out it so many constraits as mentioned in our forum many times.
Few people are always with negitive attitude and lazy, do not even listen to them.
Many families will get benifit from this effort.

Remember that you have to be in the country to apply for I-485.

Is this true for Consular Processing applications as well ? I thought CPs are filed at the local US consulate (Mumbai in our case). Additionally, I have a question about I-485 - CP filing and retrogression. Once we file the 485, does the CP get stuck in case there is retrogression in a few months time or is it that once we have applied the process keeps going ? Thanks in advance for the information.

If we are educated and highly skilled that doesnot mean that we deserve automatic benefits.
In USA, political system works on coalition. If you help others then they help you in time of need.
How many of us have helped others without thinking "what is in it for me". I have seen people who are stuck in FBI Name Check and they dont help people with F1, H1, GC issue, so when one gets what (s)he wnats, everyone else is ignored.
If we want to stay in USA, then we have to leave our sofas and help other ogranizations in their cause. you don't have to agree with everything they say, but some things can always be agreed upon.
This is what I learnt from Congressman Keith Ellison.
So be part of political process at every level..city, state, etc..
Then when time comes and you need help, you will have people behind it..

Prince,
You will be fine as per the rules. Just make sure you hire a very capable and reputed attorney, just in case the one you have isnt the best. I faced something like this, with 140, and went to one of the big firms we quote many times here and the case was approved with an MTR in just 20 days.. DOnt loose heart. But make sure you do the documentation whatever is needed and make no compromises there. Provide more thats relevant.

Still waiting on I-485 denial notice.... its almost 13 days and haven't received it yet. My attorney called them and asked for FAX of denial notice.

It's a valid point from ur prospective, but let me give u the example if the shoe was on the other foot..

* In a few weeks, all the 20 in the retrogressed country find opportunities among dozens of giant offshoring firms that quickly send them on H1 or L1 projects, within months or may be a year they are settled in the US and at most in 2003 their greencard process is up and running
Now THAT is over-generalization. You think all of us Indians and Chinese get jobs as soon as we graduate in giant offshoring cos? My friend you're stereotyping. It is wrong to assume that we get our jobs because of our nationality and not our skills.
Anyway, continuing with my example. My friend and I both found jobs after a few months of struggle in small boutique consulting companies (run by Americans), mind you no offshoring. In fact my friend's sponsor is Indian, my sponsor is American!
* The 20 equally qualified non-retrogressed however linger in their homeland for years and duke it out till the brightest 3 manage to find a rare opportunity that only comes every several years.. those 3 finally come to the US in 2005 and may be start their gc in 2006

I agree a universal 7% limit for any coutry regardless of its population and number of college graduates is stupid.. the percentages need to be adjusted. But to tell me that the 3 unretrogressed have to stand at the end of the line behind the equally qualified 20 retrogressed who came here faster (and chose to come here knowing their homeland is retrogressed) that is really fair.. yeah right!
Yup. Standing your turn in line is fair. And that's what needs to change. EB visas are about skills and not nationality.
You need to quit stereotyping and being unfair to us by saying we get jobs because of our nationalities. Brother, you don't get degrees or jobs because you're Indian or Chinese, but because you add value.

I have been speaking to colleagues and friends. Not many were aware of the rally others didn't think it would make an impact.After I showed them the website and BBC news article they were listening. I was hesitant to come there now that i was there i will attend a 2nd, 3rd and everyone. People in different parts of the country should lobby and bring 20-30 people and then you'll see numbers. Before the rally run some ads on popular channels and newspapers and motivate them.

One thing I wish to add is that we must develop a good way of sending out many letters at will/as per the strategy of IV core to the lawmakers at critical times. We are 23K strong. Surely we can get atleast as many letters sent in to lawmakers at critical times. If you can't send a written petition to a lawmaker then I doubt it makes any sense to even think you or anyone can alter your fate, in that case time spent on sites like this is for what reason?
Professional organizations do letter campaigns all the time and get a good response. If everyone moves on these issues it does create a splash and can bring visibility and attention.
All ideas should be collected here in this thread.

If your case is EB2 worthy. It makes a lot of sense. I have many friends who did that and they have their GCs now. While I'm rotting in this mess... my fault: I didn't convert to EB2 which I could have.

How would one decide if the conversion has merits? In my case, I have EB3(I) PD of 2003. In the past 5 years, I've gained progressive experience thru my job. Is there any benchmarks or guidelines on when to convert from EB3 to EB2?

I realized the clout that IV has grown when we got the Visa Bulletin reversal. This clout will only get stronger as Logiclife has explained. If you relate to politics in your own countries, the bigger the crowd at a politicians meeting; the bigger his clout. They can hire people to lobby for them and follow them around as a show of strength. Similarly in US if more organizations support a politician and if they can lobby independently for his agenda, it is a show of strength for him.
If you have observed election campaigns, you will see that all the ads are "Paid for" by some third party claiming no direct relation to the politician. This is the support structure in US and now after the rally IV is an organization which can provide such support as a return favor to our agenda being pushed ahead.
For the guys who sat on the sidelines and snickered at us, you have to realize we are the "brightest and the best" and we will not do something for the sake of doing it unless we know what the effects of such actions will be. We always see the big picture so just join us and work for this cause which is critical to all of us.
