The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

I am working for a MNC and I got L1 visa stamped. After marriage I got my H4 visa stamped.(After L1 stamping) But the Visa officials have not marked the L1 visa cancelled in the passport, does it mean that the Visa is still valid? Does that mean that i can still travel on my L1 visa?

Hi,
My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

While filling my biographical information form (I-325a) I forgot to add one of my residential address which was in a different city where I stayed only for 2 months. I was wondering will that be a major issue?
I remember this is the address I gave when I got a job and they did a background check on me. If there are any repercussions how do I rectify the solution, can some one please respond?

No he doesn't have pending GC status.His wife is on 4th year of H1 and she already got EAD.But her priority date is not current (Sept 06)to add him to her GC status immediately.

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

Hi,
I am GC holder & right now I am living out side USA with my husbad whom I am married for more than 8 yrs. I have 2 kids, they are US citizen. I visit my parents (US Citizen) every year to US for couple of months & come back. In past my husband tried for US visitor visa few times but he was denied. Is there any way I can apply for my husnad a non immigrant VISA from US for a visit? As we would not like to migrate to US but just to visit there. Is there any way or I have to apply for him immigrant visa only & wait for 5-7 yrs.?
Please guide.

I have been working with a consulting company since June 2006. I have an approved Perm and approved 140 with the same company.
Before my Perm and 140 were approved we got my H1-b extended till September 2011.
I am planning to visit my home country and need to attend for Visa stamping. I have booked my tickets too.
The problem is my company has recently changed its location and I have the old address on my paperwork (I-797, LCA etc)
But the latest pay stubs have the new Address.
Will I have any problems when I attend for Visa stamping?
Do we need to apply for the ammendment? In that case should I postpone my trip, get the paperwork and then go for stamping?

I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?
