Are you really sure that your H1B is still valid? My understanding is, only one type of Visa will be issued to a country for an individual, they cancel previously valid visas.

Company A filed my PERM in Sep 2008 showing 5 yrs job experience as of April 2005 .
I joined Company B citing 6 yrs job experience as of Dec 2009 due to various reasons.
Joined Company B in Dec 2009 and have H1b valid till April 2011 which is when my 6 year period ends.
My issues are:
1. If Company B files for my 7th year extension using the pending PERM, will the job experience discrepancy pose any problems ?
2. Does Company B have to know all the details in my pending PERM or just the case number to use it?
3. What is the earliest Company B can apply for 7th year extension?

Is the renewal form I-131? Isn't it same as applying for FRESH AP??
No where on the form we indicate that this is a RENEWAL??

Relax! Wait for couple of days. Sometimes it takes time to get updated. If you don't see anything in couple of days, call USCIS customer service.

Hi Gurus,
I wanted to know if I can work for H-1B with my current company which holds my H-1B and work outside with another company on EAD. Is there a chance that I may loose my H-1B status if I work with EAD.

Friends,
I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.
I will complete my 3 years. But after this project is over, I don't know I can find the job again.
My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?
What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.
I am really confused. Please give me your suggestions

I will not suggest you to do anything in DR. They are not really very organized and it take time even to get a DR visa but that just my personal opinion. Consult your lawyer..

Given the above case can I still transfer my H1-B to a new employer with 3yr extension? I have heard that after the 6yr period H1-B is over sometimes there are cases where 3-yr or new 6yr period H1-B are issued. Can someone advice me whats the best scenario for me?

The A# that is listed on my I-485 receipt notice is different from the one listed on my approved I-140. In addition, the number listed on my I-485 receipt notice has only 8 digits instead of 9. From reading various forums, I've heard both sides of the story...some are saying that something like this needs to be corrected, and some others are saying that the A# is just a file number, and eventually gets consolidated.
I called USCIS customer service, but they weren't much help as they couldn't pull up the information in their system.
Any inputs? I'm planning on inquiring about this when I go for fingerprinting. Also curious to know if anyone's A# on their approved I-140 has nine digits, and if the one on the I-485 receipt notice only has 8 digits.

My wife came to US on a L2 dependant visa in June 2007. She applied for EAD and got the same in Oct 2007. She was applying for jobs and both of us had to travel to India for couple of weeks in Dec 2007 due to personal reasons. After coming back, she got a job and is working now using the EAD that she got before the travel to India. Is it legal to work with the EAD she got earlier? I have this doubt because the I-94 with which she got her EAD is not the same as what she/I currently hold.

I would like to know can i change employer after my i-140 got approved.My i-140 got approved 6 months back and i have h1 until next year
You can shift to new employer and start the GC process again. The approved I-140 is useful to retain the PD if not revoked. Otherwise no use.

Below is my situation regarding the change of status. Could you please help on this
My Wife Has entered US with H4 on April 16th 2006
Her H1 Visa Approved for her on : Oct 1st 2007
Worked on H1 with an Employer: May 2008 to Oct 2008
Later: From Oct 2008 to Now -- NO PAYSTUBS
Her employer advises her to cancel her H1 and change back to H4. Will there be any problem with this? And how do we go about it.
Also to add to the problem, I have actually filed my H1Visa extension which expires on May 09 and got an RFE on the same. My Employer is responding to the same. Based on this case, How do I go about applying for my wifes change of status

YOU CAN. You have two options
You can interfile, the current 485 can be changed to approved 140 (eb3)
or
You can port the approved 140 priority date to the current 140 (eb2).

If you can't show you have had 3 years of experience at the time the labor was filed...you will most likely have hard times getting I140 approved.....the service centers are very thorough regarding work experience.
