A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

It depends, on several factors inlcuding which service center it filed, is there any RFE or any document missing etc.
In ideal case it geenrally takes 4-8+ weeks.
If you want any fater within 2 weeks) you can file under premium prossing with addtional 1000$ fee.

My Parents have 10 yr visitor visa. They came to USA, stayed for 4 months and left in July 09. Now they want to come again in October 09 and stay for 6 months. Is it possible? Do they face any issues at POE? Gurus please give your valuable thoughts or experiences?

Hi,
My I-140 was approved in May and I am still waiting for I-485 approval. I filed in August 2007 concurrently and my Priority Date is June 2004.
I thought that concurrent filing will also mean concurrent approval, but may be this is not the case. Otherwise should I call NSC and ask them about it (whats the best way to call them ?)

Hi,
I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.
Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.
This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.
Anonymous users please sign in at IV using any ID , and update all the information related to any communication in the past with USCIS.

Hi, I was in India when my husband applied for my H1B in 2008. I got it picked in lottery and got the approval too. I came to US on H4. After Oct 1st 2008, we applied for Change of Status to H4 to legally complete the work permit process. In the Change of Status applicatin form, my company accidently did a mistake of mentioning that Current status=H1B, New status required=H1B. :mad: USICIS, on seeing the application, took a decision to give me H4 with new I-94. I tried calling the USCIS helpdesk, but in vain. :confused:
1) Now what should I do to start working in H1B?
2) Was I correct in ging throughChange of Status? Or could I start working with the approval copy I had?
3) Could I apply for SSN with the 2008 approval copy?
Any answers would be greatly apprrciated!. Thanks in advance........

I hear from multiple sources that a concurrently filed 485/140 with 140 in premium is the fastest way to process.
Does this make sense ?
It could be as 485 does not have a A number till 140 is approved.
Once 140 is approved, then have to open the corresponding 485 and enter that information and proceed with its processing ????
So I believe this one is faster than even the approved 140 case submission of 485 ?
Any comments ?

My wife will be coming back in April 2nd week through Denver. CO POE. Her AP is valid until June 3rd week.
My question is that is 2 months of AP validity / cushion enough or safe to enter the US.
Will she get a 1 year I-94 validity from the date of entry or only until her AP expires?

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).

I made address changes to pending EAD renewal and I-485 yesterday in the afternoon for myself and spouse. Same day later in the evening I got email saying CPO for EAD renewal. This is a story of 8/20/2008.
I tried called 800 number and was told that they can't verify that address was successfully changed on the application.THey don't have access to personal information. They are asking me to take Inforpass to verify the address.
There is no LUD on either I-485 or EAD renewal after address change. Is LUD an indication that address change has been done? There are no infopass available for 2 months ( I will keep checking if somebody cancels )
Does anybody has any pointer as to how I can verify address change without infopass

has anybody else had the problem where their D70 just stops responding?
mine just suddenly stopped responding.
all i see is the CF light flashing and thats about it.
if i press the menu button the menu pops up for less than a second and disappears again.
tried resetting the camera, changing battery, CF card.
all sorts of fun stuff. has anybody encountered such behaviour?

I filed for I751 (remove condition of my green card) on June 2007. Received by USCIS on June 07, 2007. I already received my extension and the biometric appointment.... still on Texas center. How long you think I have to wait until I get a response of approval??? they said (before they got behind) that it takes 6 months.... December will be 6 month.... who knows what is really happening on immigration??? what cases they are putting behind and what cases they are working on??? (I know that the time schedule says April 07, but in the last month they only process cases receive on 4 days, last month said April 3 and this month April 7)
The thing is that I want to change my Job, but who will ever hire me with only a 1 year extension green card!!! help please!

My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.
